Sale at public auction will be on October 14, 2026 at 2:00 pm,  local time at the usual and customary location at the West Door Crockett County Courthouse, 1 South Bells Street, Suite 2, Alamo, TN 38001, pursuant to the Deed of Trust executed by James D Bivens, deceased and Constance M. Bivens for the benefit of Mortgage Electronic Registration Systems, Inc., as nominee for AmeriHome Mortgage Company, LLC, its successors and assigns, as Beneficiary, dated December 7, 2023, of record in Book 349 Page 436, in the Registers Of Deeds Office for Crockett County, Tennessee, (“Deed of Trust”), conducted by James E. BEING THE SAME PROPERTY CONVEYED TO JAMES DALE BIVENS BY QUIT CLAIM DEED FROM TINA MARIE BIVENS DATED 07/23/2021 AND RECORDED 07/26/2021 IN RECORD BOOK 170, PAGE 739, IN THE REGISTERS OFFICE OF CROCKETT COUNTY, TENNESSEE. 

BEING THE SAME PROPERTY CONVEYED TO JAMES D BIVENS AND CONSTANCE M. BIVENS, HUSBAND AND WIFE, AS TENANTS BY THE ENTIRETY, WITH RIGHT OF SURVIVORSHIP BY QUIT CLAIM DEED FROM JAMES DALE BIVENS, A MARRIED MAN, JOINED BY HIS SPOUSE, CONSTANCE M. THEREAFTER JAMES D BIVENS DIED ON 10/13/2025, THUS VESTING TITLE IN THE SURVIVING JOINT TENANT CONSTANCE M. BIVENS.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; and  unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of trust, including right of redemption of any governmental agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this foreclosure sale.

It appears from the allegations of the Complaint in this cause, the Motion for Service by Publication and statements made in court that Roxie Williams, David Blagg, and the unknown heirs of Charlie Williams cannot be served with ordinary process at law as, after diligent inquiry by the Plaintiff of the whereabouts of the said Defendants, their whereabouts cannot be ascertained.

It is therefore ORDERED the Chancellor has decreed that Roxie Williams, David Blagg, and all unknown heirs of Charlie Williams shall enter an appearance thirty (30) days after the last publication of this Order and file an answer to the Complaint, or judgment by default shall be taken against said Defendants for the relief demanded in the Complaint. The same shall be served on the Plaintiff’s counsel in the address below. A copy of this Order shall be published for four consecutive weeks in The Crockett County Times, located at 40 S. NOTICE OF SALE OF REAL ESTATE

WHEREAS, by Deed of Trust dated April 30, 2009, and recorded on May 7, 2009, in the Register's Office of Crockett County, Tennessee, in Trust Deed Book 255, Page 403 ("Trust Deed"), James S. Smith and wife, Vicky Y. Smith conveyed to Travis Edmondson, Trustee, the real estate therein described, to secure the payment of certain indebtedness therein described; and

WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and FirstBank, the lawful holder of the indebtedness, has declared the entire balance due and payable; and
